Abstract

The present article aims to analyze the development of the legal treatment of the environment in the light of the Brazilian legal system, with emphasis on the period following the 1988 Constitution of the Federative Republic and on the principles linked to environmental preservation and protection. On the occasion, this work sought to contextualize the evolutionary line of the environment as an asset to the law, culminating in its holistic phase, in which the right to an ecologically balanced environment is considered a basic right. The work also brought up the discussion about the role of the Judiciary Court in the current context of public activities aimed at sustainability, as well as the change in its way of proceeding, overcoming the limited character of its jurisdictional activities and going into the development of activities on various fronts. To illustrate the above, the article presented a successful case that took place in the State of Rondônia, which involved the participation of the Court of Law of the State of Rondônia, in addition to other powers and with the local population of the Vale do Guaporé region - the Recycling Habits Project. Finally, the present work brought the positive results related to environmental awareness and protection as a result of the aforementioned project, fostering reflection on the importance of the role of the Judiciary Court in preservation, in the light of the current context of judicial protection of this good.
