Abstract

This thesis is part of the line of research State, Transnationality and Sustainability. Its general objective is to demonstrate Brazil’s right to take advantage of the Strategic Natural Resources of the Brazilian Amazon to obtain Development and achieve economic and social prosperity, based on the decisions of International Organizations that recognize the same right for other countries in relation to their Natural Resources. The thesis contains for chapters. The first deals with the True Brazilian Amazon: the Amazon Biome. It highlights the existence of a large quantity of natural resources that constitute a Brazilian Strategic Patrimony, especially the abundance of water. It discusses the ruling of the Brazilian Supreme Court on the TIRSS demarcation and the safeguards that preserve the power of empire and the dominion of the Union over people and place, and recognizes that there are international interests in the region. It affirms that the Amazon is a typical transnational space because its territory spans nine different countries; The second chapter addresses Transnationality in more detail, as well as Globalization and the issue of risk that exist in a world in Crisis, and that are characteristic of Post-Modernity. Relevant international bodies are highlighted, discussing their performance and some judgments made to resolve international disputes, emphasizing the search for the ratio decidendi of each one, in order to apply the same reasoning in favor of Brazil; In the third chapter, it is demonstrated that Brazil is a great preserver of the environment, with 55.8% of its territory preserved. It also demonstrates the high levels of hunger and poverty in the country, with 26.5% of its population living in poverty, and 7% living in privation; The fourth chapter argues that Brazil has the right to Development and proposes a stronger use of the resources of the Brazilian Amazon, using mechanisms asymmetric democracy to extract from the population how much of the Ama­zon should be protected. The conclusions show that the five hypotheses rai­sed are confirmed, affirming that: there are foreign interests in the Amazon; economic and social development are needed in Brazil; there is an internatio­nal consensus that guarantees the right to use the Strategic Heritage of the Amazon; Brazilian society must decide on this use; it is desirable to create the embryo of an Amazonian transnational democracy and a network of mutual protection among the Amazonian countries. This study proposes the preser­vation of 50% of the true Brazilian Amazon, reducing the legal reserve to 20% in the Amazon Biome. The method of inducting reasoning was adopted throu­ghout the research.
