Abstract

ABSTRACT

This work had as general objective to analyze the collegiate decisions of the Judiciary of Rondônia, in which the entry “environmental protection” appears to assess how this theme has been decided in the judicial arena of Rondônia. The scientific method used was inductive, as from the analysis of each judgment, a general conclusion was reached. The study showed that in the Courts of Appeals of the Small Claim there were few cases involving environmental protection. Despite the small sample, in the civil area it was reaffirmed that the limitation on property by APP is not indemnifiable and in the criminal area it was found that the most common crimes (90.90%) were against fauna and in 72.2% of the cases, environmental violators were punished. Regarding the Court of Justice, the collegiate decisions were 100% favorable to environmental protection in the actions that debated the unconstitutionality of the legal provision, in the civil appeals they were 84.02% (142 of 169 decisions) favorable, in the interlocutory appeals they were 100% favorable , in the other civil actions the decisions (31 in total) were 100% favorable and in criminal appeals, 66.66% were punished for committing environmental crimes (28 out of 42 appeals). These numbers of the survey allow us to state that the idea of protection and care for the environment, that has matured over the years at the international and national level, had positive effects on the collegiate jurisdictional action of the Judiciary in Rondonia.

Possui graduação em Direito pela Universidade de Cuiabá (2000), Doutorado em Ciência Política no DINTER UFRGS/FCR, Mestrado Profissional em Poder Judiciário pela FGV-RIO (2009), MBA em Poder Judiciário pela FGV (2007), Pós-Graduação em Gestão Pública com ênfase em Administração Judiciária pela EMERON/RO (2015) e Pós-Graduação lato sensu em Direito Ambiental (AMBRO) pela EMERON/RO (2021). Atualmente é Juiz de Direito do Poder Judiciário de Rondônia, Juiz Coordenador do Centro Judiciário de Solução de Conflitos e Cidadania (CEJUSC) de Porto Velho, professor da Escola da Magistratura de Rondônia (EMERON), Membro do Conselho Superior da EMERON e Membro do Comitê de Redação Científica do Centro de Pesquisa e Publicações Acadêmicas (CEPEP) da EMERON.

Diretor da Escola da Magistratura do Estado de Rondônia (biênio 2020-2021). Mestrando em Direitos Humanos e Desenvolvimento da Justiça (DHJUS), da Universidade Federal de Rondônia (UNIR), em parceria com a Escola da Magistratura do Estado de Rondônia (EMERON).Pós-graduado em Estudos Avançados sobre Crime Organizado e Corrupção pela Escola da Magistratura do Estado de Rondônia (EMERON). Especialista em Direito Penal, pela Universidade Federal de Rondônia (UNIR); Possui graduação em Direito pela Fundação Eurípedes Soares da Rocha - Marília/SP. É Desembargador do Tribunal de Justiça do Estado de Rondônia, tendo sido eleito ao cargo de Corregedor-Geral da Justiça, no biênio 2012-2013. Atuou como Procurador de Justiça do Ministério Público do Estado de Rondônia no ano de 2004. Atuou como Promotor de Justiça do Estado de Rondônia (1985-2004). É professor de Direito Ambiental da Escola da Magistratura do Estado de Rondônia (EMERON), desde o ano de 2006; Foi Vice-Presidente do Colégio de Corregedores Gerais do Brasil (ENCOGE), no ano de 2013. Possui experiência na área de Direito, com ênfase em Direito Público, atuando principalmente nos seguintes temas: Processo Penal, Administrativo e Direito Ambiental.
