Abstract

ABSTRACT

The present study aims to analyze the development of the judicial approach to the environment in light of the Brazilian law, with emphasis on the period following the 1988 Constitution of the Federative Republic and on the aspects of the underlying principles related to environmental preservation and protection. On the occasion, we sought to contextualize the environment’s evolutionary line as a good of interest to the law, resulting in its holistic phase, in which the right to an ecologically balanced environment is now regarded as a fundamental right. The study has also discussed the role of the Judicial Branch in the current context of public activities focused on sustainability, as well as the shift in its acting emphasis, going beyond the framed character of its jurisdictional activities and into the development of activities on different fronts. To illustrate the above, the paper presented a successful case in the State of Rondônia, jointly with other branches and the Vale do Guaporé’s local population – the Recycling Habits Project (Projeto Reciclando Hábitos). Lastly, the present study disclosed the positive results regarding the environmental awareness and protection arising from the aforementioned project, encouraging reflection on the importance of the role of the Judicial Branch in preservation, in light of the current context of legal protection of this asset.
