Abstract

ABSTRACT

This article intends to present a study on the protection of the environment, a legal-criminal asset, using environmental crimes of abstract danger, considering the principle of offense and its corollary principles in constitutional criminal law. It turns out that in crimes of abstract danger the purpose is to punish a behavior, by mere presumption of damage to the protected legal interest, without the need for injury, as an actual injury is not required, but the simple practice of a conduct considered dangerous to incur sanction. Otherwise, for the principle of offense, Criminal Law should only act to punish conduct that has effectively attacked the protected legal asset (environmental) or exposed to a relevant danger, that is, the legal model must describe a conduct that be able to violate a property protected by criminal law (nullun crimen sine iniuria). This issue will be addressed in accordance with the Brazilian legal system, using doctrine, research and legal observations to formulate arguments on the subject.
