THE MARIA DA PENHA LAW APPLIED TO SUPPORT TRANSGENDER WOMEN

Abstract

This study focuses on analysing the applicability of the Maria da Penha Law to transgender women. Initially, it introduces key concepts essential to understanding the topic, such as gender and sexuality. Furthermore, it traces the historical development of legislation aimed at protecting women, the adoption of gender-sensitive judicial protocols, and the actions of the Court of Justice of the State of Rondônia in addressing and applying new legal frameworks in its rulings. The study also explores the reasons behind the low uptake of Emergency Protective Measures (MPUs) by the target audience, investigating whether underreporting might be caused by errors in the MPU request forms or by shortcomings in inclusion policies implemented by the judiciary or other institutions responsible for safeguarding access to justice, particularly for minorities, such as transgender women. Using a mixed-method approach (qualitative and quantitative), with applied, exploratory, descriptive, and explanatory objectives, supported by documentary and bibliographic research, the study aims to propose a reformulation of the questions included in the risk assessment questionnaire and MPU request forms. These revisions are intended to improve the versions used by the judiciary of Rondônia, as well as those issued by the Women's Police Station, Public Defender's Office, and Public Prosecutor's Office.
