Abstract

The present work aims to present a study on the feasibility of using satellite images as evidence in a lawsuit, especially in the context and realities of the Amazon region, whose extensive floristic coverage and biodiversity are constantly object of harmful anthropic action. The production of wealth is sometimes accompanied by serious environmental damage in which, not infrequently, the judge finds serious difficulties in the instruction and judgment of the case. The use of satellite images to verify the occurrence and extent of environmental damage, even when presented in the records by the litigants, that is, without the need for expert evidence, is a real possibility, considering the existence and availability of free access to various platforms of remote sensing. This issue will be addressed in accordance with the Brazilian constitutional and legal system, based on doctrine, scientific conceptualization of remote sensing and jurisprudential research, in order to offer arguments on this topic
