Abstract

The present study addresses the crime of damage to public forests and the problem of dealing with the deforestation inflicted to public forests in the Brazilian Law. Its main purpose is to analyze the article 50-A of the Law n. 9.605/1998, which punishes deforestation, economic exploitation or degradation of public domain forests, whether planted or native, without the authorization of the appropriate body. We used the deductive method, as well as the research techniques of bibliographic and jurisprudential reviews, with a qualitative approach. The article concludes that the criminalization of public forest damage affords effectiveness to the Law n. 11.284/2006, which deals with the management of public forests for sustainable production and is an appropriate strategy for dealing with the environmental damage that takes place within these protected territorial areas.
