Keywords: The constitutional warrant of the right to property with land title
regularization can effectively contribute to the defense and preservation of the
environment. For that matter, this study establishes as a problem: what are the
challenges for the implementation of titling to the occupant of rural land and its
general objective is to analyze the main contributions of land tenure regularization in
the protection of the environment. So, it seeks to conceptualize land tenure, property
social function and environment protection, and to present parameters for rural
people to acquire the title of their area, and also to present the main impacts derived
from the lack of title of the areas. From an applied, exploratory research, based on
secondary sources and a qualitative approach of the data, the passage demonstrates
that the creation of land governance as a land regularization policy, with institutional
and legal frameworks and with the definition of processes and measures necessary
for land title regularization is essential as a contribution to environmental protection.
