Abstract

This article analyzes the legal and psychological foundations of Restorative Justice (RJ), focusing on its practical and theoretical application in cases involving children and persons with disabilities (PwD). Based on Brazilian legislation — especially the National Council of Justice (CNJ) Resolution No. 225/2016, the Child and Adolescent Statute (ECA), and the Brazilian Inclusion Law (LBI) —, the study offers an interdisciplinary reflection on the limits and potentialities of RJ within the context of social inclusion, rights protection, and a more humanized response to conflict. The paper argues that the effective participation of these groups requires methodological adaptations and attention to their cognitive, communicational, and emotional specificities, calling for an integrated approach between Law and Psychology.

Doutor em Ciências Jurídicas pela UNIVALI/SC em parceria com a FCR/RO. Mestre em Poder Judiciário pela FGV/RJ. MBA em Poder Judiciário pela FGV/RJ. Especialista em Direito Constitucional e Eleitoral, pela PUC/GO. Juiz de Direito da Comarca de Porto Velho/RO - Poder Judiciário do Estado de Rondônia.

Marcilene da Silva, Faculdade Católica de Rondônia

Possui graduação em Direito pela Universidade Salgado de Oliveira (2008). Tem experiência na área jurídica, com ênfase em Direito Civil e atuação voltada à defesa dos direitos fundamentais. Atualmente é acadêmica do curso de Psicologia pela Faculdade Católica de Rondônia, com interesse nas áreas de psicologia jurídica, desenvolvimento infantil e proteção social. Atua em pesquisa de campo sobre acolhimento institucional e desenvolvimento emocional na primeira infância. Possui cursos complementares na área da psicologia do desenvolvimento, saúde mental, práticas educativas e inclusão social
