ABSTRACT
Based on the observation that climate change is a fact and the role of the judge who works with environmental issues is faced with the requirement of intergenerational solidarity, this article embraces three objectives: the first is to provide a critical account on the insignificance or not of environmental legal asset; the second is to describe the various possible modes of conduct found in art. 46, caput and sole paragraph of Law 9,605/1998 (irregular timber transportation); and, finally, the third is to analyze the recent decisions by the Superior Court of Justice, regarding the application or not of the principle of proportionality in relation to the total loss of the seized wood; seizure of the vehicle used as an instrument of crime; absence of subjective right to the condition of faithful depositary of the good used as an instrument in the irregular transport of wood. For this purpose, the descriptive and analytical method, will be used, as noted, based on the author's empirical experience as presiding judge of the Special Criminal Court of Ji-Paraná/RO.
