Ressocialização e Remição da Pena por meio do Acesso à Leitura e da Escrita no Sistema Prisional de Porto Velho

Resumo

Este trabalho tem como objetivo apresentar o direito do acesso à educação aos presos condenados, do regime fechado, semiaberto e aberto, inclusive os presos provisórios do Sistema Penitenciário de Porto Velho, capital do Estado de Rondônia, através do ato da leitura e da escrita como condição para a ressocialização e remição da pena. Tem como justificativa que o acesso ao estudo e à leitura e escrita, na prisão, leva a compreender o direito humano de educação para além dos limites da sala de aula comum, isto é, a escola como lugar e/ou enquanto um equipamento físico onde se transmite conhecimento. Ainda, perpassa pelo ideal da liberdade compreendendo-a como categoria da educação, para enfim analisá-la através do espectro dos direitos humanos e do exercício da cidadania. Aqui a liberdade está associada à autonomia do sujeito, haja vista ser a liberdade a condição máxima do sujeito se mover e se situar no mundo, sem estar desvinculada da responsabilidade do sujeito consigo mesmo e com a sociedade, com o princípio da dignidade da pessoa humana. Para isso se funda nas bases de Paulo Freire (1998; 1999; 2001; 2011); Flávia Piovesan (2003; 2011); Ingo Wolfgang Sarlet (2004; 2011); e outros. Também para fins de compreensão da realidade dos encarcerados, e da propositura da leitura e da escrita como atos de ressocialização e para fins de remissão da pena, discorre sobre a história da educação nas constituições brasileira (1824 a 1988), destacadamente visando a educação pública como direito social conforme disposto na Constituição da República Federativa do Brasil, de 1988, no artigo 205. Logo, a educação nesse aporte é considerada como um direito multilateral e consiste no processo que capacita o ser humano a livremente desenvolver o senso crítico, a adquirir personalidade e dignidade, permitindo participar ativamente da vida social de modo livre, com tolerância e respeito à vida e às regras sociais. A metodologia proposta é da pesquisa-ação, numa perspectiva qualitativa, a fim de conferir como está o acesso à leitura e à escrita no sistema prisional de Porto Velho, e de que forma estão sendo aplicadas as políticas públicas de incentivo a essas práticas educativas, com fornecimento de material didático e espaço físico. Por fim, como produto final a ser desenvolvido no âmbito prisional em Porto Velho-RO, propõe a “Norma para a implantação do Projeto “Ler e escrever a liberdade: remição da pena pela leitura que liberta e transforma vidas no sistema prisional de Porto Velho””.

ABSTRACT

This research aims to present the right of access to education to convicted prisoners, from the closed, semi-open and open regime, including the provisional prisoners of the Porto Velho Penitentiary System, capital of the state of Rondônia, through the act of reading and writing as condition for resocialization and redemption of the penalty. Its justification is that access to study and reading and writing in prison leads to an understanding of the human right to education beyond the confines of the common classroom, that is, the school as a place and/or as physical equipment where knowledge is transmitted. Still, it goes through the ideal of freedom, understanding it as a category of education, in order to analyze it through the spectrum of human rights and the exercise of citizenship. Here freedom is associated with the autonomy of the subject, since freedom is the maximum condition of the subject to move and situate himself in the world, without being detached from the responsibility of the subject to himself and to society, to the principle of the dignity of the human person. For this it is based on the bases of Paulo Freire (1998; 1999; 2001; 2011); Flávia Piovesan (2003; 2011); Ingo Wolfgang Sarlet (2004; 2011); and others. Also for the purpose of understanding the reality of the imprisoned, and the proposition of reading and writing as acts of resocialization and for the purpose of remission of the pen, he discusses the history of education in the Brazilian constitutions (1824 to 1988), especially aiming at public education, as a social right in accordance with the Constitution of the Federative Republic of Brazil of 1988, in article 205. Therefore, education in this regard is considered as a multilateral right and is the process that enables the human being to freely develop critical sense, to acquire personality and dignity, allowing to participate actively in social life freely, with tolerance and respect for life and social rules. The proposed methodology is action research, in a qualitative perspective, in order to check how is access to reading and writing in the prison system of Porto Velho, and how are the public policies to encourage these educational practices, with supply of teaching material and physical space. Finally, as a final product to be developed in the prison context in Porto Velho-RO, it proposes the “Norm for the implantation of the Project “Reading and writing for freedom: reduction of prison time for reading that liberates and transforms lives in the prison system of Porto Velho””.
