The State Law no. 4.610/2019 brought a challenge to the environmental agency of the state of Rondônia responsible for licensing high impact activities, giving it the decision to waive the Environmental Impact Study and its respective Environmental Impact Report (EIA/RIMA) for installations deemed not to cause significant degradation to the environment. The objective of the research was to understand how the cases that emerged in 2019 and 2020 were analyzed by the secretariat technicians and what would be the criteria adopted. Three cases were identified in this period, one of them before the publication of the law and all related to the activity of port organizations. The data were collected within the environmental agency, through technical documents favorable to the waiver of the EIA/RIMA contained in the licensing processes, in the information system (SEI) and in the process management system (SIGLAM). For a better understanding of the cases, the data were compiled in two tables indicating the criteria and aspects found that were most considered in the technical pieces, as well as the impacts identified for fauna, flora, water, soil, population and economy. As a result, we realize that there is no previously established method for these analyzes and there is also no case-by-case verification of impacts on the biotic, physical and socioeconomic environments, pointing out the need to adopt recommendations for the use of fixed criteria whenever possible.
