BBetween punishment and care: restorative justice and domestic violence from the perspective of critical criminology

Abstract

This article analyzes the use of Restorative Justice in addressing domestic and family violence against women, based on a critical reading of the Brazilian judicial model. Drawing on the contributions of Salo de Carvalho, Daniel Achutti, and Thomas Mathiesen, the study engages with critical criminology and penal abolitionism, highlighting that punitive rationality still guides the institutional practices of the justice system. Based on the report “Piloting Restorative Justice: The Role of the Judiciary” (CNJ, 2017), it is evident that the institutionalization of restorative practices has been marked by procedural reductionism and functional appropriation for procedural relief, which compromises its emancipatory potential. In contrast, it is argued that the application of Restorative Justice in cases of domestic violence should transcend mere conciliation, promoting spaces for active listening, accountability, and the reconstruction of community ties. Based on integration with public policies on gender, education, and social assistance, a restorative model committed to transforming power relations and overcoming patriarchal culture is proposed. It is concluded that only Restorative Justice guided by a critical and anti-prison perspective can effectively contribute to the protection of victims and the promotion of a culture of peace and equity.
