Violência intrafamiliar como fator de acolhimento institucional: análise documental de casos na vara da infância e juventude da comarca de Jaru/RO

Abstract

This article analyzes the extent to which public policies for child and adolescent protection, articulated with the Rights Guarantee System and the role of the Judiciary, have ensured the right to family and community life for children and adolescents subject to the protective measure of institutional care, with special attention to intrafamily violence as a triggering factor of family separation. The study adopts a qualitative, descriptive approach, grounded in bibliographic and documentary research, based on data collected in 2025 from cases processed at the Children and Youth Court of the Judicial District of Jaru, Tribunal de Justiça do Estado de Rondônia (TJRO). The 30 institutional care cases were analyzed through content analysis following Bardin (2011) and categorized based on intrafamily violence, expressed in neglect, ill-treatment, physical, psychological, and sexual abuse, as the main driver of family separation. The results indicate significant gaps between the normative framework and institutional practice, as well as structural challenges that undermine the effectiveness of judicial measures and family reintegration. It is concluded that overcoming prolonged institutionalization requires transformations in public policies, strengthening of the Judiciary's technical teams, and consolidation of the intersectoral protection network.
