Resumo

Parte-se de uma postura crítica ao sistema de justiça criminal, tributário da lógica hobbesiana/weberiana do estado nação moderno e sustentado por uma visão monolátrica de paz. Problematizando-se o conceito de justiça retributiva, objetiva-se demonstrar a viabilidade prática da aplicação de metodologias de Justiça Restaurativas para se lidar com conflitos derivados do sistema de justiça criminal, com base no referencial teórico-metodológico da filosofia das muitas pazes e da transformação evocativa de conflitos. Baseado em pesquisa bibliográfica e na pesquisa-ação, resultante do trabalho como facilitador, o autor, relatando três casos no qual atuou diretamente, demonstra impactos individuais e sociais positivos e benéficos das intervenções restaurativas indicando sua efetividade e aplicabilidade em conflitos oriundos do sistema de justiça criminal.
